Technical Regulation on cosmetics: what changes from 3 August 2026

From 3 August 2026 Ukraine's Technical Regulation on cosmetic products, approved by Cabinet of Ministers Resolution No. 65 of 20 January 2021, applies in full. It transposes the European Regulation (EC) 1223/2009 into Ukrainian law — the same rules under which cosmetics are sold in the European Union.

Notification instead of certification

The main change is notification. Before reaching the market, every cosmetic product is registered on the Ministry of Health's electronic portal: ingredients, category, manufacturer, country of origin, presence of nanomaterials and the responsible person's details. This is not state approval but an official notice: responsibility for product safety lies with the business.

Responsible person

Every product on the market must have a responsible person — a company registered in Ukraine. It is accountable for the product's compliance and consumer safety and keeps the product's technical file.

Product file and safety report

The file (Product Information File) contains the description and formula of the product, the safety report, a description of the manufacturing process and proof of compliance. It is kept for at least 10 years after the last batch. The safety report is prepared by a specialist with a medical or pharmaceutical education: they assess each ingredient and the finished product, stability in the packaging and the effectiveness of preservatives. Manufacturing must comply with the ISO 22716 good manufacturing practice (GMP) standard.

What must be on the label

  • Full ingredient list in international INCI nomenclature
  • Responsible person's details
  • Batch number
  • Expiry date or period after opening (PAO)
  • Intended use of the product, if it is not clear from the name

Who is responsible for what

PartyResponsibilities
ManufacturerSafety assessment, technical documentation, notification before market launch
ImporterResponsible for product compliance if the manufacturer is outside Ukraine
Distributor, retailerChecks labelling and notification; does not allow a product to be sold if it knows or has reason to believe that it does not meet the requirements

Transition rules

ProductsWhat is allowed
Placed on the market before 3.08.2026 without notificationMay be sold until the end of the shelf life, but no later than 3.08.2030
New batches after 3.08.2026Only after notification
Certain banned or restricted substancesSpecial deadlines until 2027–2028 for placing on the market and until 3.08.2030 for sale

The deadlines up to 2030 were set by Cabinet of Ministers Resolution No. 737 of 4 June 2026, which takes effect six months after publication. It does not postpone the date of 3 August 2026. Keep invoices and supplier documents: they prove when the goods entered the market.

Who supervises

Supervision is carried out by the State Service of Ukraine on Medicines and Drugs Control (Derzhlikservice): scheduled and unscheduled inspections and withdrawal of products that do not meet the requirements.

What this means for the consumer

Cosmetics on the shelf undergo the same safety assessment as in the European Union, and the label carries the full ingredient list and a responsible company in Ukraine that you can contact.

How Beautymarket works

For the brands in our portfolio we handle notification, the responsible person function and Ukrainian labelling. For brands entering the Ukrainian market, we help them complete these steps before the first shipment.
